1. Agreement to These Terms

These Terms of Use (the "Terms") set out the rules that apply when you access or use websites, online services, applications, games, software, digital content, community features, customer support channels, and related services made available by BlazeNina Limited (collectively, the "Services").

The Services are operated by BlazeNina Limited, located at RM. 2, 3/F., RUBY COMM BUILDING, 480 NATHAN ROAD, KLN YAU MA TEI, HONG KONG ("BlazeNina," "Company," "we," "our," or "us"). By using the Services, creating an account, downloading our software, making a purchase, or continuing to browse our website, you confirm that you accept these Terms. If you do not accept them, you should stop using the Services.

2. Eligibility and Use by Minors

You may use the Services only if you are legally able to enter into these Terms and are not barred from using the Services under applicable law.

The Services are not directed to children under 13. If you are under 13, you must not use the Services or submit personal information through them.

If you are at least 13 but have not reached the age of majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian. The parent or guardian is responsible for the minor's use of the Services, account activity, purchases, and compliance with these Terms.

We may request information reasonably needed to confirm eligibility, parental consent, or account ownership. We may limit or suspend access if the information is not provided or appears inaccurate.

3. Accounts and Security

Some features may require an account. You agree to provide accurate and current registration information, keep that information updated, and avoid using names or profile details that are misleading, unlawful, infringing, or offensive.

You are responsible for keeping login credentials confidential and for activity that occurs through your account, except where the activity results from our failure to use reasonable security measures. You should notify us promptly at the email address listed below if you believe your account has been accessed without authorization.

Accounts are intended for personal use and may not be sold, rented, transferred, assigned, or shared as a commercial service. We may refuse, suspend, rename, or close an account where we reasonably believe these Terms have been breached.

4. Limited License

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, lawful, non-commercial purposes.

This license does not give you ownership of any software, content, account, virtual item, brand asset, or other part of the Services. All rights not expressly granted to you are reserved by BlazeNina and its licensors.

5. Acceptable Use and Restrictions

You agree that you will not, and will not assist anyone else to, misuse the Services. In particular, you must not:

• copy, modify, translate, adapt, reverse engineer, decompile, disassemble, or attempt to extract source code from the Services, except to the extent applicable law expressly allows;
• use cheats, bots, scripts, automation, unauthorized third-party tools, exploits, or other methods that interfere with fair use or normal operation;
• probe, scan, overload, disrupt, or bypass security, rate limits, authentication systems, access controls, or technical protections;
• collect account data, user content, or service data through scraping, crawling, harvesting, or automated queries without our written permission;
• upload or transmit malware, harmful code, spam, fraudulent messages, or content that infringes another party's rights;
• use the Services for illegal, harmful, abusive, defamatory, sexually exploitative, hateful, discriminatory, harassing, or deceptive activity;
• sell, resell, lease, host, or commercially exploit the Services or any access to the Services without our prior written consent.

6. User Content and Community Conduct

The Services may allow you to post, upload, send, create, or share text, usernames, images, gameplay materials, feedback, comments, or other content ("User Content"). You remain responsible for your User Content and for ensuring that you have the rights needed to share it.

You grant BlazeNina a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to host, store, reproduce, display, perform, adapt, moderate, remove, distribute, and otherwise use your User Content as needed to operate, improve, promote, and protect the Services. This license ends when your User Content is deleted from our active systems, except where continued use is reasonably necessary for backups, legal compliance, safety, dispute resolution, or materials already used in accordance with the license.

We may moderate, remove, restrict, or refuse User Content that we reasonably believe violates these Terms, applicable law, third-party rights, or the safety and integrity of the Services. We are not required to monitor all User Content, and the absence of moderation does not mean we approve any content.

7. Virtual Items, Digital Content, and In-Service Features

Where the Services include digital currency, points, boosts, skins, cosmetic items, subscriptions, access passes, downloadable content, or similar in-service features (together, "Virtual Items"), those Virtual Items are licensed to you for use within the applicable Service only.

Virtual Items are not money, electronic money, stored value, investment products, or property that can be sold for cash. They have no cash value, cannot be redeemed from us for money or other value, and may not be transferred except through functionality we expressly provide.

We may update, rebalance, modify, remove, suspend, or discontinue Virtual Items or related features for business, legal, operational, security, or gameplay reasons. Unless applicable law requires otherwise, you are not entitled to a refund, exchange, or compensation because of such changes.

8. Purchases, Billing, and Refunds

Purchases may be processed by third-party platforms, app stores, payment processors, or other service providers. Your purchase may be subject to their terms, payment rules, taxes, currency conversion, refund procedures, and account requirements.

You represent that you are authorized to use the payment method selected for a purchase. Prices, availability, features, and promotional offers may change at any time before a purchase is completed.

Except where applicable law or the relevant third-party platform requires a different result, purchases are final and non-refundable once fulfilled. If your account is closed, suspended, or terminated because of your breach of these Terms, unused Virtual Items or paid features may be forfeited without refund to the maximum extent permitted by law.

9. Intellectual Property

The Services, including software, artwork, characters, designs, gameplay elements, text, interfaces, graphics, audio, video, databases, trade names, trademarks, service marks, logos, and all related intellectual property rights, are owned by BlazeNina, its affiliates, or its licensors.

You may not use our names, logos, brands, or content in a way that suggests endorsement, partnership, or ownership unless we give written permission. Nothing in these Terms transfers any intellectual property rights to you.

If you submit suggestions, ideas, bug reports, or other feedback, you agree that we may use them without restriction or compensation, provided we do not identify you publicly as the source without your permission.

10. Service Changes, Availability, and Support

We may improve, update, patch, suspend, withdraw, replace, or discontinue any part of the Services from time to time. We may also impose limits on access, storage, features, or usage where reasonably necessary.

We aim to provide reliable Services, but we do not promise that the Services will always be available, secure, uninterrupted, error-free, compatible with every device, or free of harmful components. Maintenance, network issues, third-party outages, security events, legal requirements, or operational needs may affect availability.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy or any privacy notice made available for the relevant Service. By using the Services, you acknowledge that personal information may be processed as described in those notices.

You are responsible for ensuring that any personal information you submit about another person is provided lawfully and with any required consent.

12. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. BlazeNina disclaims all warranties and representations, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

You are responsible for your own device, internet connection, software environment, data backup, and use of the Services. You understand that online services may involve errors, delays, security risks, and changes in functionality.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

To the maximum extent permitted by law, BlazeNina and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings, even if we have been advised that such damages may occur.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to BlazeNina for the relevant Service during the six months before the event giving rise to the claim; or (b) HKD 1,000.

14. Indemnity

You agree to defend, indemnify, and hold harmless BlazeNina and its directors, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:

• your use or misuse of the Services;
• your User Content;
• your breach of these Terms;
• your violation of applicable law or third-party rights;
• activity through your account, unless caused by our failure to use reasonable security measures.

15. Suspension and Termination

You may stop using the Services at any time. If account deletion tools are available, you may use them to request closure of your account, subject to retention that is reasonably required for legal, security, fraud prevention, accounting, backup, or dispute purposes.

We may suspend, restrict, or terminate access to the Services, with or without notice, where we reasonably believe that you have violated these Terms, created risk for other users or the Services, engaged in fraud or abuse, infringed rights, or where suspension is needed for legal, security, or operational reasons.

Sections that by their nature should survive termination will continue to apply, including provisions concerning ownership, User Content licenses, payment obligations, disclaimers, liability limits, indemnity, dispute resolution, and miscellaneous terms.

16. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will take reasonable steps to notify users, such as posting an updated version on our website, displaying an in-service notice, or using other appropriate communication channels.

The updated Terms will apply from the date stated in the updated version or from another effective date we identify. Your continued use of the Services after the updated Terms become effective means you accept the changes. If you do not agree, you should stop using the Services.

17. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising from or relating to them or the Services are governed by the laws of Hong Kong, without regard to conflict-of-law rules.

Before starting formal proceedings, you and BlazeNina agree to make a good-faith effort to resolve the dispute informally by written notice and discussion for at least 30 days, unless urgent injunctive relief or another immediate remedy is reasonably required.

Subject to any mandatory consumer rights that apply in your place of residence, the courts of Hong Kong will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

18. Miscellaneous

If any part of these Terms is found invalid or unenforceable, that part will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining parts will continue in effect.

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign or transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, or by operation of law.

Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms, together with any policies or additional terms incorporated by reference, are the entire agreement between you and BlazeNina regarding the Services.
